User License: When you purchase a Product from Deft Media, you acquire a License (“User License”) to use the sounds within your own musical compositions, regardless of commercial release. By making a purchase on this website, you are automatically bound to the terms of the User License.

The User License grants you a non-transferable, lifetime, royalty-free license to incorporate the sounds into your musical compositions. This license is exclusive to the purchaser and permits commercial use.

You are permitted to combine the sounds with other elements in your musical works.
You may release your compositions commercially without the need for additional fees or royalties.

Reselling or distributing the purchased sound libraries is strictly prohibited.
Uploading the sound collection to any file sharing network is not permitted.
Using the sounds in isolation, separate from a musical composition, as part of a commercially released project is not allowed.
Creating another Sample Pack or any audio sample collection using the sounds is prohibited.
Using the sounds in isolation for sound effects on a website, multimedia, audio, or video production, unless as part of a musical performance or in composition with other sounds, is not permitted.

You acknowledge that Deft Media has a proprietary interest in all sound recordings on or within the Site. Any use that frustrates the purpose of this Agreement or circumvents Deft Media’s revenue model, such as selling, renting, or distributing un-integrated Content, may result in irreparable loss that cannot be adequately compensated by damages.

Trademarks: The brands, products, and service names mentioned on this Site, including but not limited to “Daniel Marchewka” and “Deft Media,” are trademarks or trade names of Deft Media or its partners, unless stated otherwise. Prior written permission is required to distribute products, offer services, or use/reproduce any such trademarks, trade names, or taglines. It is important to note that you may not use Daniel Marchewka’s name in reference to any composition created using Products purchased from this site without prior written permission.

Limitation of Liability: You agree that the liability of Deft Media to you under this Agreement shall be limited to the amount you have actually paid to Deft Media for its services.

Indemnity: You agree to indemnify Deft Media for any loss or damage that may be incurred by Deft Media, including but not limited to legal fees, arising from your use of the Site or your use of any information obtained through the Site.

Severability: If any part, term, or provision of this Agreement is held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall remain valid and continue in full force and effect.

No Partnership: Your use of the Site and its Content does not create a partnership, client relationship, fiduciary duty, or any other professional relationship.

Refund Policy: Due to the nature of our downloadable products, we are unable to provide refunds unless there is a proven fault with the product. Please ensure that you make your purchase with care, as mistakes cannot be accepted as a valid reason for refunds.
